These Terms of Use govern your use of the Pulse Internet Speed Test app (the "App"), provided by Capware LLC ("we", "us", or "our"). By downloading or using the App you agree to these terms.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices you own or control, subject to these Terms and Apple's App Store Terms of Service.
Permitted Use
The App is intended for personal, non-commercial use to measure your own internet connection speed. You may not use the App to:
- Deliberately generate excessive traffic to our testing infrastructure
- Attempt to reverse-engineer, decompile, or disassemble the App
- Use the App in a manner that could damage, disable, or impair our servers
- Resell or redistribute the App or its results for commercial purposes without our written permission
Accuracy of Results
Speed test results reflect conditions at the time of the test and may vary based on network congestion, server load, device hardware, and many other factors. Results are provided for informational purposes only and do not constitute a guarantee of network performance. We make no representations or warranties about the accuracy of results.
Availability
We may modify, suspend, or discontinue the App or its testing servers at any time without notice. We are not liable for any interruption of service.
Intellectual Property
The App, including its design, code, and branding, is owned by Capware LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other intellectual property.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAPWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
Changes to These Terms
We may update these Terms from time to time. Changes will be reflected by an updated effective date on this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
